Understanding Australian Penalty Rates

Penalty rates are additional payments made to employees who work outside standard working hours. In Australia, these rates are set by Modern Awards and are designed to compensate workers for the inconvenience of working during times when most people have time off.

When Do Penalty Rates Apply?

Saturday Work

Most awards provide 125-150% of the base rate for Saturday shifts. Retail workers typically receive 125%, while warehouse and healthcare workers often get 150%.

Sunday Work

Sunday rates are typically 150-200%. Full-time retail workers receive 200% (double time), while casuals may receive 175%. Hospitality workers generally get 175%.

Public Holidays

Most awards provide 250% (double time and a half) for public holiday work. This is the highest penalty rate in most awards.

Evening & Night Shifts

Evening shifts (typically after 6pm or 7pm) often attract 110-125% loading. Night shift and early morning rates vary by award.

Casual Loading Explained

Casual employees receive a 25% loading on top of their base hourly rate to compensate for:

  • No paid annual leave
  • No paid sick leave or personal leave
  • No guaranteed hours
  • Irregular work patterns

When penalty rates apply to casual workers, the penalty is calculated on the base rate (without casual loading), and then the casual loading is added. This means casuals can earn significantly more for weekend and public holiday work.

Overtime Rates

When you work more than your ordinary hours (usually more than 38 hours per week for full-time, or more than your rostered hours for part-time), overtime rates apply:

  • First 2 hours: Time and a half (150%)
  • After 2 hours: Double time (200%)

Note that overtime rates typically don't stack with other penalty rates. If you work overtime on a Sunday, you would generally receive the higher of the two rates, not both combined.
