Understanding Overtime in Australia
Overtime pay in Australia is governed by the Fair Work Act 2009 and various Modern Awards. Most full-time employees work 38 hours per week as standard. Any hours worked beyond this are considered overtime and are usually paid at penalty rates, unless you're on a higher duties allowance or have overtime built into your salary package.

Reasonable Overtime
Under the Fair Work Act, an employer can request that an employee works reasonable overtime. What's considered "reasonable" depends on several factors:
Factors Considered

You Can Refuse If

Time Off In Lieu (TOIL)
Some employers offer Time Off In Lieu (TOIL) instead of overtime pay. Under most Awards, TOIL must be agreed in writing and is typically given at the same rate as the penalty rate would apply.
Example: 4 hours at double time = 8 hours TOIL. However, some Awards require TOIL to be taken within a certain period (e.g., 6 months) or you're entitled to be paid out.
Award-Free Employees
If you're not covered by an Award (typically professionals earning over $175,000 or senior managers), your overtime entitlements depend on your employment contract. The National Employment Standards still apply, including maximum weekly hours of 38 plus reasonable additional hours.
